Citation Abstract: Constitutional review is a cornerstone of the rule of law, ensuring the supremacy of the Constitution and the protection of rights and freedoms. In Algeria, constitutional control has evolved through the 2016 and 2020 constitutional amendments, which expanded access to constitutional review by introducing the exception of unconstitutionality and transforming the Constitutional Council into a Constitutional Court. This study aims to assess the role of the exception of unconstitutionality in enhancing the protection of individual rights and freedoms under the 2020 amendment, evaluate its effectiveness in activating constitutional justice, and identify key challenges along with proposed solutions.
