Citation Abstract: This study examines the issue of women being deprived of their inheritance rights, particularly in southern Palestine, due to prevailing customs and traditions. It explores the legal and jurisprudential implications of a woman’s silence in claiming her inheritance and whether such silence leads to forfeiture of the right or prevents the claim due to prescription. The study also analyzes the conditions required for a valid waiver of rights and identifies the competent authority to hear such claims, in light of Islamic jurisprudence and positive law.
